In her initial allegations, Ennis told Los Gatos-Monte Sereno police that Foster "punched her in the head 8 to 10 times", rupturing her eardrum, but also that Foster hit her "hard, but not that hard", according to a police report.

Foster is scheduled in court Tuesday morning. The latter was found on the floor of the bathroom with a loaded 30-round magazine and a round in the chamber.

However, Ennis last month recanted her account of the alleged domestic violence by Foster and handed over to the District Attorney's office a video that she claims shows her in an altercation with another female during which Ennis suffered her injuries.

Ennis said the row continued the next day and escalated to where Foster began throwing her clothes and other belongings off the balcony. She tried calling the police as she later escaped the house, but when she fell down Foster threw her phone, breaking it. Ennis then went to a nearby intersection and flagged down a driver to call 911.

"She was extremely upset and told him if he broke up with her she would 'trash his career, '" Rickard said.

The alleged victim in the case against Reuben Foster initially told police the 49ers linebacker threw her out of his Los Gatos home three times following an argument on the morning of February 11, the last time after hitting her approximately 10 times "hard, but not that hard" with his fist.

Foster is now awaiting a verdict for three felonies charged from the Santa Clara District Attorney's Office last month: domestic violence with an allegation that he inflicted great bodily injury, forcefully attempting to prevent a victim from reporting a crime, and possession of an assault weapon.

Foster reportedly physically dragged Ennis out of the home multiple times, according to the police report, as she kept making her way back inside.

Foster was present and his attorney, Josh Bentley, informed the court of Foster's position in the case related to a domestic violence incident that carries three formal charges.

Barrows also reported that officers smelled marijuana in Foster's Los Gatos home. Despite his missed time, Foster finished second on the team in tackles.

Upon arriving at the scene, police took photos of Ennis' injuries, which included a swollen right lower lip, scratches and a cut on the back of her neck and a scrape on her left knee. However, general manager John Lynch stated on April 23 that if the linebacker did hit Ennis, he would not be a part of the 49ers' future.

The 49ers have asked Foster to stay away from the team facility and the ongoing offseason program until his case is resolved or there's a significant development. County District Attorney's Office made a decision to proceed with the charges.

"The gravity of these charges has not been lost on us", Lynch said. "We try to have a consistent standard, but of course, talent kind of dictates some level of that".
