NYPD confirms to ET that Cuba Gooding Jr. has been arrested and charged with forcibly touching, which is a misdemeanor.
The Jerry Maguire star had planned to meet with NY cops to be arrested and face questioning for a misdemeanor charge of forcible touching following an allegation he groped a woman's breast in a nightclub on Sunday, June 9, but his attorney, Mark Heller, has admitted that may not now be the case. Gooding's lawyer, Mark Heller, told the Associated Press that video from the bar showed his client did not commit a crime and "there is not the slightest scintilla of inappropriate conduct on his part".
Heller says he plans to "vigorously defend" the Boyz n the Hood and Jerry Maguire actor.
As we reported, the Jerry Maguire actor was said to have touched the accuser inappropriately as they were socializing at the venue.
"Nothing in the video could even be considered ambiguous, and I frankly am shocked and horrified that this case is being prosecuted", he added.

The woman, whose name has been kept confidential, told police that Gooding groped her buttocks when she met him at the Butter Restaurant in Midtown New York, according to the Daily News. "The victim later told cops she protested at the unwanted touching and they argued about the encounter". In that case, a bartender said the actor was agitated with customers who wanted photos with him and that he pushed her when she asked him to leave.
An unidentified woman called police to report that Gooding, who was "highly intoxicated" at the time, grabbed her breast at about 9 p.m.at the Magic Hour Rooftop Bar and Lounge.
NYPD spokeswoman Detective Sophia Mason said she had seen the news report, but had no information on it.
Gooding denied groping anyone during a brief interview with TMZ, telling the outlet, "I trust the system and the process will speak for itself". The bartender later dropped all charges, according to reporting from CNN.
